Chapter 3: The Commission

I.
Philadelphia in summer offered no mercy. By three in the afternoon the air in Adams's private study had thickened past endurance, and the windows, shut against the stench rising from the gutters below, had accomplished nothing except to seal the heat inside with the papers and the man. He had been at his desk since seven. The list before him bore six names, three of which he had already crossed through.
He was sorting the remaining documents—the consular returns from Martinique, the shipping manifests, Pickering's latest memorandum on French depredations, presented in that characteristically neat hand which converted catastrophe into ledger entries—when the knock came. He did not look up.
'Mr. Secretary.'
Pickering entered without hurry, without hesitation, in the manner of a man who has decided the room is already his. He placed a letter on the corner of the desk with the flat deliberateness of a man laying down a wager he expects to collect. 'From New York. I thought it material to the question of the commission's composition, which I understand remains under consideration.'
Adams aligned the Martinique returns against the desk's edge, corner to corner. The heat pressed at the back of his neck like a hand. He aligned them again.
'It remains under my consideration,' he said. 'In what sense it is under yours, I confess I have not determined.'
Pickering had the quality of going still when other men would have shifted. He stood with his hands at his sides and read the letter aloud—itself a form of assertion, that the document required vocal delivery, that it was too consequential to be merely handed over. The General's argument, he said, was as follows. A commission of three envoys communicated to the Directory not the authority of the American executive but its hesitancy: three voices where one was required, three sets of instructions where unity was demanded, three men who would disagree behind closed doors and present the residue of their disagreement to a government that understood only the grammar of resolved force. A sole envoy, appointed with full executive warrant, spoke as the republic. Three commissioners spoke as a republic that had not yet decided what it wished to say.
Pickering folded the letter.
Adams pressed his sleeve to his face, blotting the sweat from his brow, and extended his hand.
Pickering surrendered the letter. Adams read it—the full two pages, slowly, the way he had read briefs in which he had already located the fatal clause and wished to find it once more. He read without expression. He slid it beneath the Martinique returns so that only its edge showed.
'I wrote to General Pinckney on Wednesday,' Adams said. 'I wrote to Mr. Marshall on Wednesday. I wrote to Mr. Dana on Wednesday.' A pause. The heat was enormous. He did not lower his voice. 'The letters have gone out.'
Pickering's stillness sharpened. His hands remained at his sides.
'Without the General's support, the vote will not be called.' He let the silence do the rest.
Adams looked up for the first time. 'The General will conduct himself as a private citizen of this republic, which he is, until such time as the Congress sees fit to appoint him otherwise.' He set his pen on the blotter. 'I would be grateful, Mr. Secretary, if you would turn your attention to the envoys' instructions. That, at present, is where I require your assistance—not your intelligence from New York.'
Pickering retrieved the letter from the desk. He did not fold it. He held it at his side as he withdrew, and the outer door closed behind him with the quiet precision of a man who has calculated the price of a slammed door and found it too dear.
The heat did not diminish. Adams pulled the Martinique returns toward him and found Hamilton's letter beneath them, its edge still showing. He pushed it back under. But the hand that had written it was already moving—he was certain of that. If Hamilton could not dictate the commission's composition, he would dictate its instructions. If he could not dictate the instructions, he would dictate the Senate's reception of whatever the commission brought home. The letters had gone out. The question was whether they had gone out fast enough.
II.
The Madeira had been poured before the company was fully settled, and Adams observed, as he observed all such things, that Sedgwick had reached for his glass before the ladies were seated. A small deficiency of manners, perhaps not worth remarking—and yet a senator who could not wait for the hostess to be comfortable was a senator who could not wait for the President to finish his reasoning, either. Adams noted it and moved on.
The roasted fowl arrived in a cloud of sage and rendered fat, and for a quarter-hour the conversation kept to the safe shallows of New England harvests and the price of wool in Springfield. Mrs. Tracy spoke warmly of the curtains in the east parlour. Mrs. Sedgwick admired the silver candlesticks. Abigail received these observations with a graciousness that Adams had long since ceased to marvel at, though he remained, in some private corner of his estimation, entirely incapable of replicating it.
Sedgwick waited until the second glass was poured.
'I wonder, Mr. President'—the title preceded the knife—'whether you can give this company your assurance that none of the gentlemen you have named to this commission are known to harbour sympathies of a French character. I raise the question not from any personal animus toward your choices, you understand, but because the Senate will require a satisfactory answer before it can confirm them, and I should rather you had the benefit of that intelligence now than in committee.'
Adams turned his wine glass slowly by the stem, watching the candlelight move through the Madeira—the amber deepening toward the base, thinning near the rim.
'General Washington,' he said, 'appointed men of differing persuasions to his commission at Jay's instance. He did not first demand that each gentleman certify his political temperament to the satisfaction of the Senate caucus. The precedent, I believe, is established.'
'The precedent, if I may observe, was established under different circumstances, and by a man whose authority was—'
'Whose authority was precisely what authority is: the confidence of the people, exercised through the instrument of the executive.' Adams returned the glass to the cloth with a deliberateness that silenced the table. 'I do not recall that the Senate undertook to audit General Washington's affections for foreign nations before confirming his appointees.'
Sedgwick arranged his fork beside his plate. 'All the same. The question stands, Mr. President. I put it to you plainly: if one of these gentlemen proves, in Paris, to be more sympathetic to French interests than to American ones, the consequences will fall upon this administration—upon you—and I should not wish to see that occur.' He held Adams's gaze across the candles. 'Confirmation can be delayed indefinitely. I trust you are sensible of that.'
The bone from the fowl caught between Adams's teeth mid-reply. He worked it free with his tongue, swallowed, and resumed. 'I am satisfied that the gentlemen I have named will conduct themselves—'
'My father,' said Abigail, from her end of the table, with the composure of one who has chosen her moment to the minute, 'was a man of most exacting practice in the matter of extending credit. He held, as a principle, that a creditor who sends only the men already in agreement with him into a negotiation will find, at its conclusion, that he has reached terms no one else will honour.' She took a small sip of Madeira. 'He required, therefore, that his most trusted negotiator be capable of understanding the debtor's position—not of sharing it, you will appreciate, but of comprehending it well enough to find terms both parties could sustain. He was rarely disappointed.'
The candles breathed. Sedgwick looked at his plate.
'A most—practical philosophy,' he said at last.
'He was a practical man,' Abigail replied. 'As, I believe, are the gentlemen my husband has named.'
Tracy reached for the salt. The conversation moved, with the decorum of a tide withdrawing, toward the subject of road improvements between Philadelphia and New York, and did not return. But Sedgwick refilled his glass without being asked, and Adams, watching him do it, understood that the delay he had promised was not an idle threat. If the caucus convened on the fourteenth without a third commissioner confirmed, Sedgwick would have the numbers to strip the commission to a single envoy—and that envoy would not be Adams's.
III.
The house had drawn itself in. Somewhere above, a board contracted in the cooling air with a sound like a knuckle cracked, and then nothing—the silence of a building that has finished with its company and is now only itself.
Adams had dismissed the last servant. Abigail sat across from him in the study, still in her dinner dress, the pearl buttons at her wrist catching the single candle's light. The papers on his desk were as he had left them—the half-written letter to Murray, the list of names, the space where Hamilton's letter had rested before he moved it to the drawer without discussing it.
'Dana will not go,' she said.
'I have no letter from Dana refusing.'
'You will. And when you do, the fourteenth will be nine days away, and Sedgwick will move to reduce the mission to a single envoy—Hamilton's man, not yours. You will have lost the commission before it sails.'
Adams pushed back his chair and stood. The floorboard groaned under his weight. He crossed to the window; the night air had cooled the glass, and the chill ran up through his wrist when he pressed his palm against it. 'Dana's hands were troubling him in February. I am told the cold made it worse. Whether that constitutes a refusal—'
'His hands have been unable to hold a pen since February.' She said it the way one states the price of flour. 'I had it from his wife.'
Adams turned from the window. 'Then I must find a third man in nine days, or forfeit the entire design of this commission to a Senate caucus that takes its instructions from a private citizen in New York.'
She reached into the pocket of her dress and placed a letter on the desk between them. The seal had been broken—not by him. The handwriting on the outside was Gerry's, unmistakable even at this distance, the capital E ascending with its characteristic hook.
He did not reach for it immediately. The candle guttered in some invisible current, and he cupped his hand around the flame, waiting while it found its balance again. Then he took the letter and read it.
He read it a second time.
Gerry wrote with the warmth of a man who had not yet been asked to do anything difficult. He expressed his continued esteem for the President, his conviction that the republic required men of independent judgment in Paris rather than partisan instruments, his readiness to serve in whatever capacity might prove useful. The date at the top was the fourteenth of April.
Adams held the letter toward the candle as though checking the watermark, though the paper was plain enough and he had already read every word twice.
'How long have you been writing to Mr. Gerry?'
'Since April.' Her voice did not waver.
He lowered the letter. 'Six weeks, Abigail.'
'He was willing. I wished to know it before you needed to know it.'
'And you determined I did not need to know it until this evening.'
'I determined you would use the knowledge less efficiently before this evening.' She met his eyes. 'The commission required a man who would give it a conscience and sufficient independence to resist both the Directory's flattery and Pickering's restrictions. You know Gerry. You have known him since before I knew either of you. The only question was whether he would go.'
The board above them contracted again. From somewhere outside, the night watch's footstep passed along the street and faded into nothing.
Adams set the letter on the desk.
'If I name him,' he said, 'Sedgwick will call it provocation. Pickering will go to Hamilton within the week. And the Federalist press will have the story in the Gazette before Gerry's trunk is packed—that I have sent a French sympathiser to treat with the Directory, and that the commission is therefore a capitulation dressed in diplomatic linen.'
'Yes.'
'The Senate will—'
'Yes.' She said it before he finished. 'All of that will occur. And if you do not name him, none of it will matter, because there will be no commission at all.'
He looked at her across the desk and the candle and the six weeks of correspondence he had not known about. Then he pulled the list of names toward him and wrote Gerry's name in the space where Dana's had been. His hand moved with the chopping deliberateness of a man entering a verdict he cannot appeal.
'You might have told me,' he said.
'I have told you now.'
He set down the pen. The ink was still wet on the page, and he did not blot it.
IV.
The smell reached Adams before he crossed the threshold—sealing wax and lamp oil and the iron sharpness of fresh ink, the odour of a department that ran on documents and knew it. Pickering's clerks occupied the anteroom in attitudes of industrious arrangement, papers moving from one stack to another with the self-important shuffle of men performing competence rather than exercising it.
Pickering stood at his desk as though he had not moved since the previous administration.
'Mr. President.' A slight inclination of the head. 'The envoys' ship is confirmed for Thursday. I have taken the liberty of preparing the full instructions, that we might review them this morning and have them sealed and delivered to the commissioners by nightfall.'
The draft lay open on the desk—twelve pages of fair copy in a clerk's neat hand, weighted at their corners with two brass inkwells. Beside them, bound in red tape and sealed with a provisional press of wax, a second packet, perhaps seven pages, perhaps eight. Pickering's hand rested near it without quite touching it.
'Let us see what you have prepared,' Adams said. He took the primary document and crossed to the window, where the morning light arrived in a long grey bar across the page. The sealing wax was stronger here, its smell recent, as though several packets had been processed within the hour.
He read line by line. The first page was unobjectionable—the customary recitation of grievances, the authority vested in the commissioners by the President, the requirement that they treat with the Directory in the name of the republic. The second page contained the first restriction: a clause requiring the commissioners to obtain written confirmation of French intentions before proceeding to any discussion of treaty modification. Adams drew his pen through it without ceremony and wrote in the margin, The commissioners shall exercise full discretionary judgment in determining the order and sequence of discussions.
Pickering did not move.
The third page held a clause barring any provisional arrangement touching upon consular privileges without prior referral to the Secretary of State. Adams struck it. The fourth page contained language requiring the commissioners to report in full to the department before executing any agreement—effectively making every concession subject to Pickering's revision before it could bind the nation to anything whatsoever. Adams struck that as well, and dictated to the clerk who had materialised at his elbow: The commissioners are authorised to conclude and sign such provisional articles as they shall judge consistent with the honour and interest of the United States, subject to ratification by the Senate.
The scratch of the quill was the only sound.
Adams set the document on the desk and tapped the sealed supplementary packet with one fingertip. 'Open it.'
Pickering's hand moved to the packet. A pause—brief, barely perceptible. He broke the seal.
Adams read the supplementary instructions standing. They were seven pages. By the third, it was apparent they were not supplementary at all: a parallel document, contradicting the first at every point of consequence. The commissioners' authority to conclude any agreement was suspended pending approval from the Secretary of State. All French proposals were to be submitted to the department before any response was ventured. And on the final page, in language so carefully drafted that it required two readings to comprehend its full reach, the commission's authority in all matters touching upon commerce and maritime law was subordinated entirely to Pickering's own discretion.
In the anteroom, a clerk dropped a brass inkwell. The clang rang through the wall sharp and sudden. Adams did not glance up.
He placed both documents side by side on the desk. Then he picked up the supplementary packet and held it over the candle on Pickering's desk until the corner caught.
'Mr. President—'
Adams held it until the flame had consumed the first two pages, then dropped it into the empty grate. They watched it burn together. The wax seal bubbled and blackened. The red tape curled and went to ash.
'Three clauses struck from the instructions,' Adams said. 'The replacements are to be copied fresh before the commissioners receive their copies. I will not have a document delivered with marginalia where the authority ought to be.' He looked at Pickering directly. 'The commissioners will carry one set of instructions. Mine.'
'As the President directs.'
Adams signed the document and set down the pen. 'See to it they are ready by four o'clock. And, Mr. Secretary—' He paused at the door. 'If I find, when the commission returns, that any additional correspondence passed between this department and Paris in advance of their arrival, I will know where it originated.'
He left Pickering standing in the smell of burnt paper and cooling wax. But as he passed through the anteroom, he noted that the nearest clerk did not so much as glance toward the door through which the President of the United States had just emerged. The man's pen moved steadily, his posture composed, his attention fixed on the page before him with a discipline that owed nothing to Adams and everything to the man whose department this remained.
V.
Paris. October 1797.
The room had been designed for confidence. Tall windows gave onto a courtyard where rain fell in earnest, streaking the glass and filling the space between the buildings with a grey, aqueous light that flattened every surface and made the gilded cornices look like things recovered from a fire. The ceiling fresco—some allegory of abundance, nymphs and wheat-sheaves faded to the colour of old bruises—regarded the company below with the indifference of a god who has watched too many supplications.
They had been waiting twenty minutes when he arrived.
He was not Talleyrand. Every man in the room understood it before the visitor had crossed the threshold. He was perhaps fifty, dressed with an exactitude that suggested careful expenditure rather than easy wealth, and he moved through the introductions with a fluid courtesy that had long since ceased to require thought. He spoke in French that was rapid and idiomatic, and the interpreter—a young Alsatian who had come with the mission—rendered it into English a half-beat behind, so that the room seemed perpetually to exist in two moments at once.
Pinckney sat at the head of the table. Marshall was to his left, Gerry to his right. The intermediary took the chair at the table's foot, accepted a glass of wine he did not drink, and spoke pleasantly of the Directory's great admiration for the American republic, of the natural sympathy between two peoples who had each thrown off the yoke of monarchy, of the regrettable misunderstandings that had accumulated between them—years of grievance thickening into grievance, each unanswered complaint settling upon the last.
Marshall's pen moved steadily across his memorandum book. Gerry's hands were folded before him on the table. Pinckney set both palms flat on the surface and did not move them.
The rain intensified. It struck the tall windows in successive curtains, each gust louder than the last, and when the intermediary leaned forward and lowered his voice, the effect was not of intimacy but of displacement—as though the weather had forced him to speak more plainly than he had intended.
'The Directory,' he said, and the interpreter followed, 'finds itself in a position of some delicacy. Before the Minister can receive your credentials officially—before, you understand, there can be any formal exchange of views—the Directory requires certain preconditions to be satisfied.' He paused and touched the rim of his untouched glass. 'A loan to the Republic. Thirty-two million Dutch florins. And a personal—' he chose the word with care—'douceur. For the Minister himself. Fifty thousand pounds sterling.'
The rain hammered the glass.
The interpreter finished. The room held its breath.
'I beg your pardon,' Pinckney said.
The intermediary repeated the figures. His voice was entirely even. The figures were the same.
Pinckney withdrew his hands from the table. He placed them on the arms of his chair, slowly, with the deliberation of a man setting down objects he does not wish to break. 'You will put that in writing.'
A smile crossed the intermediary's face—brief, practised, and entirely without warmth. 'I am afraid that the nature of these communications does not admit of written form at this stage. They are, you understand, preliminary. Exploratory. The expression of a disposition rather than a formal demand.'
'Then I will supply the written form myself.' Pinckney rose. He crossed to the side table where his leather case lay, drew out a sheet of paper, and set it on the table before the intermediary. 'The substance of your communication, as I have understood it, is that the Minister will not receive our credentials without prior payment of the sums you have described. I propose to record that understanding and invite you to correct it if I have misapprehended any particular.' He uncapped his inkwell and held out the pen. 'Shall I write, or will you?'
The intermediary looked at the pen. He looked at Pinckney. The smile did not return.
'I should counsel patience, General. The Directory has received other embassies that arrived with similar reservations. In each instance, the gentlemen found that the cost of accommodation was considerably less than the cost of departure.' He rose, smoothing his coat. 'I shall return when the gentlemen have had occasion to reflect upon their position.'
He bowed. He left.
His footsteps on the marble stair were distinct above the rain, then gone.
Marshall closed his memorandum book. The clasp was very small in the large room.
'He will return,' Gerry said. 'They always return when they believe the price can be raised.'
'Then we must determine what we intend to do when he does.' Marshall opened the memorandum book again and turned to a fresh page. 'Because if we refuse and remain, they will raise the demand. And if we refuse and depart, Pickering will have his war before the dispatches reach Philadelphia.'
The silence after this was of a different quality than the silence before—not the silence of men waiting, but of men who have understood, simultaneously and without comfort, the nature of the ground beneath them.
Pinckney stood at the tall window. Rain ran in unbroken sheets down the glass, and the cold came through the pane where his hand rested against it. Beyond the courtyard, the grey bulk of the city dissolved into weather, formless and indifferent. From somewhere in the streets below came the sound of iron-shod wheels on wet stone—growing louder, then passing, then gone. He turned back to face the room, and his expression, when it came into the candlelight, was not that of a man who has suffered an outrage. It was the expression of a man who has just understood the dimensions of a room he cannot leave.
The intermediary would return tomorrow. And the day after. And each time the sum would be different and the question identical: how much is peace worth, and who decides the cost? Behind them, the door stood closed but not latched—Pinckney could see, in the gap between door and frame, the faint movement of a shadow in the corridor beyond, patient and unhurried, as though someone had remained to listen and had not yet troubled to withdraw.
